TSL SMS Terms / Privacy Policy

1. Introduction

TSL Technology Solutions ("TSL," "we," "us," or "our") provides transit management technology solutions, including the TMS (Transit Management System) platform, to transportation agencies and their employees. This Privacy Policy describes how we collect, use, protect, and handle personal information, including mobile phone numbers, in connection with our services.

This policy applies to: (a) transportation agency clients and their authorized administrators; (b) Covered Employees (transit operators, dispatchers, supervisors) who receive TMS communications; and (c) visitors to tsl.tech.

1.1 How end users consent to receive messages

End users (drivers) receive SMS messages as part of their employment with transportation agencies that use the TSL platform. During employee onboarding or BYOD device authorization, the Agency presents the employee with a signed SMS Enrollment Form containing the following required disclosure: Agency SMS enrollment form

2. Information We Collect

2.1  Agency and Administrator Information

We collect contact information, account credentials, and contract-related information from agency administrators who use the TMS platform.

2.2  Covered Employee Information

For employees enrolled in TMS operational communications, we collect:

  • Employee identification number (as provided by the agency);

  • Mobile phone number (solely for delivery of TMS operational SMS messages);

  • Message delivery status and opt-out status;

  • TMS application usage logs associated with transit operations.

2.3  Website Information

We collect standard web analytics data (IP address, browser type, pages visited) through tsl.tech. We do not use tracking cookies for advertising purposes.

3. SMS Communications and Mobile Phone Numbers [SMS]

3.1  How We Use Mobile Phone Numbers

Mobile phone numbers provided to or collected by TSL through the TMS platform are used exclusively for the delivery of operational safety SMS messages on behalf of enrolled transportation agencies. These messages include:

  • Priority Request to Talk (PRTT) alerts;

  • Request to Talk (RTT) notifications;

  • Silent Alarm alerts;

  • Operational system status notifications;

  • TMS connectivity and fallback instructions.

These are operational safety communications. They are not marketing, promotional, or advertising messages.

3.2  No Sharing of Mobile Numbers for Marketing  [SMS]

TSL Technology Solutions will NOT share, sell, rent, transfer, or disclose mobile phone numbers to any third party, affiliate, partner, or marketing organization for marketing, promotional, advertising, or commercial solicitation purposes.

Mobile phone numbers collected in connection with TMS SMS services are used solely to:

Deliver TMS operational safety messages as described in Section 3.1;

Maintain opt-out/opt-in status records;

Comply with carrier and regulatory requirements (e.g., STOP/HELP processing via Twilio).

The only third party that processes mobile numbers in connection with TMS SMS delivery is Twilio Inc., our SMS infrastructure provider, which processes messages solely as a service provider under applicable data processing agreements. Twilio does not receive authorization to use mobile numbers for its own marketing purposes.

3.3  How SMS Consent Is Obtained and Managed  [SMS]

TSL obtains or verifies that the employing Transportation Agency has obtained documented written consent from each Covered Employee before enrolling their mobile number in TMS SMS communications. Consent is collected through:

A signed SMS Enrollment Form completed during employee onboarding or BYOD authorization; or

Employment agreement or collective bargaining agreement language that specifically discloses TMS SMS enrollment as a condition of employment in a transit operations role.

Consent records — including the employee's name, enrolled mobile number, consent date, and collection method — are retained by the Transportation Agency in the employee's personnel file for a minimum of three (3) years.

A confirmation SMS is sent to each newly enrolled number at the time of enrollment disclosing the message types, opt-out instructions, and a link to this privacy policy.

3.4  Opt-Out Rights  [SMS]

Covered Employees may opt out of TMS SMS messages at any time by:

  • Replying STOP to any TMS SMS message;

  • Contacting their Agency supervisor or TMS administrator;

  • Contacting TSL at support@tsl.tech

Upon receipt of a STOP reply, TSL's Twilio-integrated platform will immediately suppress further non-safety-critical SMS messages and send a one-time unsubscription confirmation.

Note: PRTT, RTT, and Silent Alarm messages are safety-critical operational communications. Employees in active transit operations roles may be subject to Agency policy requiring receipt of these specific message types. Employees should contact their Agency regarding any concerns about safety-critical message enrollment.

To re-enroll after opting out, reply START or contact your Agency TMS administrator.

3.5  Message Frequency and Rates

Message frequency varies based on operational need and dispatch activity. Standard message and data rates may apply. TSL does not charge separately for TMS SMS messages; carrier rates are the responsibility of the device owner (or the Agency, where Agency-issued devices or BYOD reimbursement applies).

4. Data Retention

Mobile phone numbers remain in the TMS system for as long as the Covered Employee is actively enrolled. Upon employee departure, device change, or opt-out, numbers are removed from the active message list within one (1) business day of Agency notification. Message delivery logs are retained for twelve (12) months.

5. Data Security

TSL implements industry-standard technical and organizational measures to protect personal information, including mobile phone numbers, against unauthorized access, disclosure, alteration, or destruction. TMS Messages are transmitted over encrypted channels. All Twilio API communications use TLS 1.2 or higher.

6. Your Rights

Covered Employees and Agency contacts may request access to, correction of, or deletion of their personal information held by TSL by contacting us at privacy@tsl.tech. Requests will be processed within thirty (30) days, subject to applicable legal obligations.

8. Updates to This Policy

TSL may update this Privacy Policy periodically. Material changes will be communicated to Agency administrators at least thirty (30) days prior to the effective date. Continued use of TMS services after the effective date constitutes acceptance of the updated policy.
